Well certainly we would like to give credit to individuals, especially law enforcement officers who might say something like that. The bottom line is a law enforcement officer is not and will not be your legal advocate. You should not take legal advice from a law enforcement officer nor should you expect that anything that a law enforcement officer may promise you is something that the prosecutor will honor or will even recognize. Many times you’re being told something like that in a scenario where that statement by a law enforcement officer is not even recorded and we may not even be able to ever prove that it was actually made to you. The best rule of thumb is that if you have any doubt at all, exercise your constitutional right to remain silent and if you’re able, call a lawyer immediately before saying anything to the police.
