In Florida, in order to be sentenced for a crime you have to have either been convicted of it by virtue of entering a plea that’s been accepted by the court who will then sentence you or you’ve gone to trial and you’ve been convicted by a jury and the Judge will then also, in that situation, determine what is an appropriate sentence for you. There are certain guidelines and recommendations and other factors that may play into what a court sentences you to under law and then under the specifics of your case. You need to speak with a lawyer to understand whether or not you have defenses or mitigating evidence to even sentencing issues that may arise relative to your charge.
